“We / us / our” means the Commercial Company EURO LACT Prest Com s.r.l.

The eurolact.ro website is owned and operated by EURO LACT Prest Com srl, a limited liability company registered in Romania with CUI RO18737839, Trade Register number J40\9236\2006, having its registered office at Str. Cazangiilor nr. 44, sector 3, Bucharest.

3. Purpose of this Policy

This Privacy Policy applies solely to your use of our Site. It does not apply to any site that is linked to our site (whether provided by us or by others). We have no control over how your data is collected, stored or used by other websites, and we encourage you to check the privacy policies of those sites before providing data to them.

4. What data do we collect?

Some data will be collected automatically by our website; see section 12 on Use of Cookies for more details. Other data will only be collected if you voluntarily submit it and consent to its use for the purposes set out in section 5. Depending on your use of our Site, we may collect some or all of the following data:

  • Your first and last name;
  • Contact information such as email address or telephone number;
  • IP address (collected automatically);
  • Browser type and version (automatically collected);
  • Operating system (automatically collected);
  • A list of URLs starting with the site from which you came to our Site, activity on our Site and the site from which you leave our Site (automatically collected).

5. How do we use the collected data?

All personal data is stored securely in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679) (GDPR). For more details on security, see section 6 below.

We use your data to provide you with the best services, including:

  • Responding to communications you initiate to us;
  • analysing how you use our Site in order to continually improve the visitor experience on our Site.

In some cases, data collection may be a legal or contractual requirement and we will not be able to deliver products or services to you unless we have your consent for us to use this data.

With your permission and/or where permitted by law, we may use your data for marketing purposes which may include contacting you by email and/or telephone to send you information, news and offers about our services. However, we will not send you any unsolicited marketing communications or spam and will take all reasonable steps to fully protect your rights and comply with our obligations under the General Data Protection Regulation and the Privacy and Electronic Communications Regulation (EC Directive) as amended in 2004, 2011 and 2015.

Your activity is monitored using cookies as detailed below in section 12. You can control and limit the data used in this way by adjusting the privacy settings of your web browser.

In accordance with the General Data Protection Regulation, we will ensure that your personal data is processed lawfully, fairly and transparently without adversely affecting your rights. We will only process your personal data if at least one of the following criteria applies:

  • You have consented to the processing of your personal data for one or more specific purposes;
  • the processing is necessary for the performance of a contract to which you are a party or in order to be able to handle your requests prior to entering into a contract;
  • processing is necessary for compliance with a legal obligation to which we are subject;
    and/or
  • processing is necessary for the purposes of legitimate interests pursued by us or a third party, unless those interests are overridden by the fundamental rights and freedoms of the data subject which require the protection of personal data. The automatic logging of the IP address from which you access the site will be done to protect us from possible criminal cyber activities.

6. How and where do we store data?

We keep your data for as long as we need to use it as described above in section 5 and/or for as long as we have your permission to keep it. In any case, we will conduct an annual review to check whether we still need to keep your data. Your data will be deleted if we no longer need it.

Your data will only be stored in the European Economic Area (“EEA”) (the EEA consists of all EU Member States plus Norway, Iceland and Liechtenstein).

Data security is of particular importance to us and in order to protect your data we have put in place appropriate physical, electronic and organisational procedures to protect and secure the data collected through our Site.

The steps we take to secure and protect your data include:

  • encrypted storage of data on Company computers/servers
  • encrypted storage of data on partner servers (e.g. the company providing the hosting service for our Site)

Despite the security measures we take, it is important to note that transmission of data over the internet is not completely secure and you are advised to take appropriate precautions when transmitting data to us over the internet.

7. Do we disclose your personal data?

We may compile statistics about the use of our site, including traffic data, usage patterns, number of users, sales and other information. All such data will be anonymous and will not include personally identifiable information. We may from time to time share such data with third parties, such as potential investors, service providers and partners. Data will be shared and used only to the extent permitted by law.

In certain circumstances, we may be legally obliged to share certain data held by us, which may include your personal information, for example, where we are involved in legal proceedings, where we are complying with the requirements of the law, a court order or a government authority. We do not require any further consent from you to allow us to share your data in such circumstances and will comply as required with any legally binding request that is made by us.

Under the terms of the General Data Protection Regulation, you have:

– Right to information: you have the right to be informed about all data processing activities carried out by Us;

– the right of access: you have the right to obtain confirmation from the controller whether or not personal data relating to you are being processed and, if so, the right of access to those data

– the right to rectification: the data subject has the right to obtain from the controller, without undue delay, rectification of inaccurate personal data concerning him or her. Having regard to the purposes for which the data have been processed, he/she has the right to obtain the completion of personal data which are incomplete, including by providing an additional statement

– the right to erasure of data: In cases where

  • the data are no longer necessary for the fulfilment of the purposes,
  • consent has been withdrawn and there is no other legal basis for the processing,
  • the person objects to the processing and there are no legitimate grounds for the processing, or
  • personal data have been unlawfully processed,

the individual has the right to obtain the erasure of data relating to him or her without undue delay

– Right to restriction of processing: the data subject has the right to restriction of processing in the following situations:

  • disputes the accuracy of the data, for a period allowing the controller to verify the accuracy of the data;
  • the processing is unlawful and the person objects to the erasure of the personal data and requests instead the restriction of their use;
  • the personal data are no longer needed for the purpose of the processing, but the person requests them for the establishment, exercise or defence of legal claims;
  • the person has objected to the processing in accordance with Article 21(1) of the GDPR, for the period of time during which it is verified whether the legitimate interests of the controller outweigh the rights of the person

– Right to object: the data subject has the right to object at any time to the processing of personal data. The controller will comply with the request unless its legitimate interests prevail or the purpose is to establish, enforce or defend a legal claim. The data subject has the right to object at any time to the processing of data for direct marketing purposes

– the right not to be subject to an automated decision with significant effect: He does not have this right if the decision:

  • Is necessary for the conclusion or performance of a contract between the data subject and a data controller;
  • is authorised by Union or national law applicable to the controller which also provides for appropriate measures to protect the rights, freedoms and legitimate interests of the data subject; or
  • is based on the explicit consent of the data subject

– the right to data portability: the data subject shall have the right to receive personal data relating to him or her which he or she has provided in a structured, commonly used and machine-readable format and shall have the right to transmit such data to another controller without hindrance on the part of the controller if the following conditions are met cumulatively:

  • the processing is based on consent or a contract, and
  • the processing is carried out by automatic means

– the right to withdraw his/her consent at any time and free of charge.

9. How can you have control over your data?

When you submit information via our website, you may be given options to restrict the use of your data by us. Our aim is to give you good control over our use of your data (including the ability to opt-out of receiving emails from us, which you can do by unsubscribing using the links provided in our emails).

10. The right to block information and the right to withdraw information once you have given it

You can withdraw your consent for us to use your personal data as set out in section 5 at any time by contacting us using the details set out in section 2 and we will delete your data from our systems. However, please note that this may block the sale and delivery of our products to you.

Our company does not use personal data for automated decision-making or profiling purposes.
